The Supreme Court (SC) has junked for being moot the petition of former and current opposition senators questioning the decision of the President Rodrigo Duterte to have the country withdraw from the International Criminal Court (ICC).
The SC Public Information Office (SCPIO) said on Tuesday (March 16) that the tribunal was unanimous in its decision to dismiss the petition “for being moot and academic.
“The decision acknowledged that the President, as primary architect of
foreign policy, is subject to the Constitution and existing statute,” the SCPIO cited the ruling penned by Justice Marvic Leonen.
“Therefore, the power of the President to withdraw unilaterally can be limited by the conditions for concurrence by the Senate or when there is an existing law which authorizes the negotiation of a treaty or international agreement or when there is a statute that implements an existing treaty,” it added.
Even without the ICC, he SC also assured “the judiciary has enough powers to protect human rights contrary to speculations raised by the petitioners.”
The petition was filed in May 2018 by Senators Francis Pangilinan, Franklin Drilon, Leila De Lima, Risa Hontiveros and former senators Paolo Benigno Aquino IV and Antonio Trillanes IV.
In their petition, the petitioners said the withdrawal from the ICC is “invalid or ineffective.”
“As a treaty validly entered into by the Philippines, the Rome Statute has the same status as an enactment of Congress. In other words, the Rome Statute is a law in the Philippines. As a law, the withdrawal from the Rome Statute requires the participation of Congress,” read the petition.
