
Human rights advocacy groups led by the United Against Torture Coalition Philippines (UATC) have asked the Supreme Court (SC) to declare as “null and void” the Anti-Terrorism Law for being unconstitutional.
“The Anti-Terrorism Act of 2020 effectively removes and/or diminishes the Constitutionally guaranteed fundamental rights, including freedom from torture, ill-treatment and enforced or involuntary disappearance,” read their petition.
Even before the passage of the law, the petition lamented that human rights continue to be violated “based on well-documented atrocities that have been happening for decades.”
“These violations of fundamental rights continue to happen and have worsened in more recent years under the current administration of Respondent [President Rodrigo] Duterte,” it pointed out.
“This is neither a conjecture nor the product of overly active imaginations,” it added.
The petition told the SC that President Rodrio Duterte has “never bothered to hide his hatred of human rights and those that work to protect and promote such rights.”
“Respondent Duterte is openly hostile to anyone he considers as his enemy, particularly, those who, in the exercise of their fundamental rights, are critical of his administration,”it cited.
Citing the Constitution, the petition reminded that, “No person shall be deprived of life, liberty, or property without due process of law, nor shall any person be denied the equal protection of the laws.”
