Acquitted na! Abogados of jailed activist push for her freedom after dismissal of charges

The camp of journalist and activist Lady Ann Salem has reminded the Mandaluyong City Regional Trial Court (RTC) dismissed charges can no longer be reversed.

Salem’s lawyers pointed this out in a pleading filed before Mandaluyong RTC Branch 209 in response to the appeal of the prosecution not to release her from detention and to reverse the dismissal of the illegal possession of firearms and explosives charges against her.

“The dismissal of the cases, drawn upon the quashal of the search warrant and consequential declaration that the seized evidence is inadmissible as evidence, is one tantanmount to an acquittal,” her lawyers explained.

“Our rules on criminal proceedings require that a judgment of acquittal, whether ordered by the trial or the appellate court, is final, unappealable, and immediately executory upon its promulgation. Thus, it is immediately executory. The defense invokes the finality-of-acquittal rule,” they added.

Salem was among those arrested by the Philippine National Police (PNP) on International Human Rights Day last Dec. 10.

The charges were filed against her after the PNP who were implementing search warrants allegedly found weapons and ammunition in her home.

However, her supporters said the evidence discovered in her home was planted.
