Parents who cannot afford car seats for their kids will not be arrested or ordered to pay a fine yet, according to Malacañang.
The Department of Transportation (DOTr) and the Land Transportation Office have decided to defer the implementation of Republic Act 11229 or the Child Safety In Motor Vehicles Act given the impact of coronavirus (Covid-19) pandemic on the economy.
“Nangako ang ating DOTr na hindi muna po sila manghuhuli ‘no pagdating doon sa mga wala pang mga car seats. Ang nangyari po diyan, talagang nasa batas, mayroong one-year period ‘no na para hindi muna ma-implement iyan, ng mabigyan ng pagkakataon na makabili/makaipon ng mga car seats ‘no,” Presidential Spokesperson Harry Roque said in a virtual presser.
“Pero tinamaan nga po tayo ng COVID ‘no. So ngayon po dahil siya ay epektibo na by law, eh nangako naman po sila; naintindihan nila ang ating kalagayan ngayon. At bagama’t iniengganyo nila na gumamit na ng car seats para sa kaligtasan ng mga kabataan eh kung hindi naman po ma-afford, hindi pa rin muna tayo manghuhuli – ito po ang commitment ng DOTr,” he added.
The Child Safety in Motor Vehicle Act, which was approved last February 22, 2019, requires the use of the child restraint systems for children who are 12 years old and below with a height of 4 feet 11 inches and below.
Drivers who fail to follow the law will be fined P1,000 for the first offense, P3,000 for the second offense, and P5,000 for the third offense.
