Cruel, inhuman: NUPL says Duterte’s order to arrest face mask policy violators

National Union of People’s Lawyers (NUPL) president Edre Olalia said President Rodrigo Duterte has no legal basis to order the arrest of persons who improperly wear face masks.

Olalia pointed out that “the legal justification is not only inapplicable but erroneous because there is no crime or offense covered by any law or ordinance for a valid instance of warrantless arrest to even remotely operate.”

“Thus it is cruel, degrading and inhuman punishment disproportionate to the evil sought to be supposedly addressed and even discriminatory,” the lawyer said.

“Additionally, the cited allowable period of detention without charges is also wrong,” he added.

Olalia said he too believes that “we should all wear masks properly”, however, “to arrest those who do not wear them or wear them improperly is another authoritarian edict akin to the law of rulers and undermines the ‘rule of law’.”

“Shouldn’t simply providing facemask for free to those who cannot afford them and launching massive popular information drives do the trick rather than overpacking our already cramped and congested jails?” asked Olalia.

“Such mailed fist cures would just worsen the problem and keep us in this slippery slope of inane coercive measures,” he lamented.
