Setting aside arbitral ruling unconstitutional? Palace to Carpio: ‘Magdemanda ka’

Malacañang urged retired Supreme Court Associate Justice Antonio Carpio to file a case if he believes President Rodrigo Duterte violated laws regarding his stance on the West Philippine Sea (WPS) issue.

“Kung talagang labag sa Saligang Batas, bakit di siya magdemanda? Abogado po siya, founder ng isang pinakamalaking law office sa Pilipinas (at) dating mahistrado ng Supreme Court. Tigil na po ang dakdak lang,” Presidential Spokesperson Harry Roque said in a virtual presser Thursday.

In his May 6 column in the Inquirer, Carpio said that it was “illegal” and “unconstitutional” for Duterte to set aside the arbitral award that ruled in favor of the Philippines and rejected China’s sweeping maritime claims in the resource-rich waters.

The President “has no power on his own” to abandon the arbitration ruling against China, which affirmed the Philippine sovereign rights in its exclusive economic zone, the former justice wrote.

To recall in 2016, Duterte said that he would not press China on the arbitral ruling on the WPS, noting that “the politics here in Southeast Asia is changing.”

“In the play of politics now, I will set aside the arbitral ruling,” he also said.
