Any move to declare Senator Ronald “Bato” Dela Rosa a nuisance candidate for running as PDP-Laban’s presidential contender will face a major legal challenge, the former national police chief said.

In an interview on One News’ “The Chiefs” Thursday (October 14), Dela Rosa maintained he’s serious about running for president even if he filed his certificate of candidacy (COC) two hours before the October 8 deadline set by the Commission on Elections (Comelec) lapsed.
Dela Rosa had said he was in Cavite when PDP-Laban officials called him to file his COC.

“Dadaan sila sa isang malaking legal battle ‘pag gagawin sa akin ‘yan at ipaglalaban ko talaga ang katotohanan. The truth is I really have a sincere intention of becoming president of this country,” he said.
“Magpa-file ba ako ng COC kung ayaw ko maging pangulo?” Dela Rosa added.
Election lawyer Romulo Macalintal earlier said Dela Rosa could face petitions to declare him a nuisance candidate because he supposedly has no genuine intention of running.
Dela Rosa is widely seen as a placeholder in case Davao City Mayor Sara Duterte decides to run under PDP-Laban as a substitute presidential candidate.

Dela Rosa, however, said it would be tough for the Comelec to prove he has no genuine intention of running.
“You want to open my heart? Gusto mo tingnan kung gaano katotoo ‘yung aking desire na maging pangulo ng bansa?” he asked. “Sige. Gusto mo, tingnan mo, open mo ‘yung puso ko para malaman mo.”

Dela Rosa admitted that while he initially did not have any plan of running for president, his filing of COC “is a clear manifestation” that he is serious about seeking the presidency.
