Sila ang mag dedesisyon! Palace defers to NTC on granting provisional authority to ABS-CBN

MalacaƱang on Monday said it will leave to the National Telecommunications Commission (NTC) to decide whether to issue a provisional authority to ABS-CBN allowing the broadcast firm to operate pending the renewal of its franchise.

“Hahayaan po namin ang NTC na mag desisyon. Kung ano man ang desisyon ng NTC ipapatupad din po yan ng buong gobyerno. So, ang desisyon ay nasa NTC,” according to Presidential Spokesperson Harry Roque.

“We will apply the exhaustion of administrative remedies. The matter ay dedesisyunan ng administrative agency which has specialized competence para mag desisyon sa mga bagay na ito which is the National Telecommunications Commission and we defer to whatever ruling the NTC may have,” added Roque.

On Sunday, the Office of the Solicitor General warned the NTC against granting ABS-CBN provisional authority, saying “the Constitution gives Congress the exclusive power to grant franchises to public utilities, such as broadcasting companies, in order to operate in the country.”

Solicitor General Jose Calida also said that no law authorizes the NTC or any other agency to grant franchises to broadcasting entities.

The 25-year franchise of ABS-CBN expires today, May 4.
