The Bayanihan To Heal As One Act will remain in effect until June 25, Malacañang said, citing its sunset provision.
Presidential Spokesperson Harry Roque’s comment came after lawmakers said the additional powers granted to President Rodrigo Duterte under the law lapsed on June 5 when Congress adjourned.
However, Roque explained that Section 9 of Republic Act 11469 states that the law will be “in full force and effect only for three months unless extended by Congress.”
The measure was signed into law on March 24 but was published the next day.
“We maintain that the effectivity of the Bayanihan Act is governed by sunset clause of the law. It is effective until June 25, 2020,” the Palace official.
Before the sine die adjournment, the Senate approved on second reading the proposal extending the President’s special powers until September 30, 2020, but failed to pass the measure on final reading.
The House of Representatives Committee of the Whole, on one hand, approved the Bayanihan We Recover As One bill on third and final reading Wednesday night.
