Over pork barrel scam: CA affirms Ombudsman’s dismissal of ex-DSWD Usec Montano

The Court of Appeals (CA) has upheld the decision of the Office of the Ombudsman (OMB) to dismiss former Department of Social Welfare and Development’s (DSWD) undersecretary Mateo Montano and two other former officials over the alleged illegal release of the Priority Development Assistance Fund (PDAF).

In a resolution, the CA turned down the motion for reconsideration of Montano, former assistant secretary Vilma Cabrera and assistant director Pacita Sarino seeking to overturn the appelate court’s Feb. 28 ruling regarding their dismissal.

“A perusal of the motion for reconsideration filed by petitioners of the Court’s decision promulgated on February 28, 2020 shows that the issues raised and arguments in support thereof have already been given due consideration and resolved,” read the CA resolution.

“Thus, this Court finds no new or substantial matters presented to justify a modification or reversal of the assailed decision. Wherefore, the motion for reconsideration is denied,” it ruled.

The OMB dismissed the three former DSWD officials grave misconduct, serious dishonesty, and conduct prejudicial to the best interest of the service following investigation conducted on the complaint filed by the Public Assistance and Corruption Prevention Office (PACPO) in 2015.

The three were accused of having facilitated the transfer of P10 million Kalookan Assistance Council (KACI) for the Cajayon Project during the term of Caloocan Rep. Mari Mitzi Cajayon.

The transfer was made in violation of a DSWD circular which mandates that only licensed and accredited non-government organizations (NGOs) and people’s organizations (PO) are eligible to accept and utilize PDAF.

The PACPO also filed another complaint against Montano concerning the release of PDAF funds for the implementation of the Asistio Projects during the term Caloocan Rep. Luis Asistio.
