The House of Representatives has approved on second reading a measure seeking to protect the physical integrity of a cultural property and penalize any obstruction to its view and sightline.
House Bill 8829, authored by Albay Rep. Edcel Lagman was approved via voice voting.
Lagman filed the measure following the controversy brought about by the construction of a condominium building Torre de Manila which became controversial after it became a photobomber of Jose Rizal monument.
“It obstructs the skyline even as it distracts the viewers from remembering Rizal’s heroism and martyrdom in Luneta and the dire effects of Spain’s colonial rule,” said Lagman in his bill.
The measure will amend National Cultural Heritage Act of 2009 (Republic Act 10066) to stipulate that the issuance of a cease and desist order by the appropriate cultural agency or the National Commission on Culture and the Arts shall also be applied to any infringement against national historical landmarks, shrines, monuments and sites including their visual impact.
Another subsection will be inserted in RA 10066 to prohibit any construction of structures that would cause adverse visual impact to any cultural property, and likewise mandates local government units to pass an ordinance for the protection of any cultural property in their jurisdictions.
