No need for fishing deal to allow fishing at disputed shoal: Palace

There is no need to sign an agreement to allow fishermen to fish around Scarborough Shoal, according to Malacañang.

“Hindi na po kinakailangang magkaroon ng kasunduan para dito sa tinatawag na joint fishing,” Presidential Spokesperson Harry Roque said in a virtual presser Tuesday.

Roque cited Paragraph 406 of the South China Sea Arbitration Award, which declares the shoal as a traditional fishing ground of Filipino, Chinese and Vietnamese fishermen.

“Iyong joint fishing na pupuwede pong mangyari sa Scarborough Shoal–kung saan ang mga Pilipino, Tsino, Vietnamese ay pwede mangisda. Hindi po iyan dahil sa kasunduan. Iyan po ay dahil sa desisyon mismo ng Permanent Court of Arbitration,” he added.

Under Paragraph 407 of the 2016 arbitral tribunal’s award, traditional fishing rights may exist even within the territorial waters of another State 381 and considers that its jurisdiction to address the dispute is not dependent on a prior determination of sovereignty over Scarborough Shoal.
