Damay employment agencies: House OKs bill enhancing protection for househelp

The House of Representatives has approved on second reading a measure that will protect both the domestic worker and their employer under the Batas Kasambahay law. (Republic Act 10361).

The proposal to amend RA 10361, authored by Deputy Speaker and Buhay Rep. Lito Atienza was approved via voice voting.

Under House Bill 9144, the private employment agencies (PEAs) shall have the responsibility to ensure that the domestic helper has no criminal record, and there is sufficient information on the bonafide residence and family background through actual verification, and to the extent possible, supported by relevant documents such as clearances or certificates from the National Bureau of Investigation (NBI), Police and Barangay.

The measure also provides that PEAs shall be subsidiary liable to any criminal act committed by the domestic worker against the employer in the course of the domestic worker’s employment.

PEAs subsidiary liability will cease after one year from the first day of the domestic worker’s employment with the employer.
