Justice Secretary Menardo Guevarra has assured that removal of onerous provisions in the new concession deal Maynilad Water Services Inc. (MWSI) will be “non-negotiable” as the government panel is set to begin talks with the company this Monday (May 3).
“There are certain provisions which, I believe, are non-negotiable,” Guevarra declared.
“The removal of the non-interference clause, the non-chargeability of corporate income tax to consumers’ water bills, no government guarantees for future debts, COA (Commission on Audit) audit, and a more transparent governance mechanism are some of these,” he said.
The government has already signed a new concession deal last March 31 with Manila Water Company Inc. (MWCI) which Guevarra assured no longer contains onerous provisions.
“Until we hear the initial comments of Maynilad, we can’t say if we’ll have a CA that is not too different from the CA with Manila Water,” he noted.
Copies of the new MWCI agreement have been sent to Maynilad prior to the setting of the initial talks.
