Walang takas! BI: Conviction for crime not needed for deportation

Foreigners who got acquitted for crimes won’t be saved from deportation, Bureau of Immigration (BI) Commissioner Jaime Morente warned.

“The acquittal of an accused in a criminal case does not bar the deportation of an alien, who has been established by competent evidence to have committed acts contrary to morals, good customs, public order, or public policy,” he said in a statement.

“Conviction of a crime is not necessary to warrant deportation,” Morente added.

Morente cited that recently Swiss-Italian Alfred Jose Honagger, 67, was cleared by the Cebu provincial prosecutor’s office from criminal complaints and, because of this, has sought that the deportation case against him before the BI be dismissed.

However, the board of commissioners that Morente chaired concurred with the findings of the BI’s Board of Special Inquiry (BSI) that Honeger is an undesirable alien for intervening in the management, operation, administration, and control of a restaurant in Cordova, Cebu.

The BI board pointed out that his presence in the country poses a risk to public interest and ordered his inclusion in the bureau’s blacklist.
