Balakayojan! Carpio hands off in filing of petition to cancel Marcos Jr’s COC

Retired Supreme Court Associate Justice Antonio Carpio isn’t keen on filing a petition to cancel former senator Ferdinand Marcos Jr.’s certificate of candidacy (COC) for president over his conviction in a 30-year-old tax case.

In an interview on One News’ “The Chiefs” Friday (October 29), Carpio said he’s leaving the filing of a petition to cancel Marcos’ COC to any registered voter.

It was Carpio who floated the idea of disqualifying Marcos from the 2022 elections in his October 28 column for the Philippine Daily Inquirer (PDI).

“Well alam na ng mga abogado ‘yan eh. After I wrote that column, I received a lot of texts. They will file… so sabi ko bahala kayo,” the retired magistrate said.

Carpio, however, said the petition to cancel Marcos’ COC can only be filed until November 2. The Commission on Elections provides that a petition to cancel or deny due course to a COC may be filed not later than 25 days from the filing of the COC.

The former Supreme Court justice said Marcos could be disqualified from running for president because he was convicted by a regional trial court for failure to file his income tax returns from 1982 to 1985 and pay the proper income taxes. The conviction was upheld by the Court of Appeals.

Carpio said that should Comelec disqualify Marcos, votes cast for him in the May 9, 2022 elections will be considered stray votes.
