The Office of the Prosecutor of the International Criminal Court (ICC) has temporarily suspended its investigation into the alleged crimes against humanity committed over the course of President Rodrigo Duterte’s war on drugs.
An ICC document dated November 18 cited the Philippine government’s deferral request as the reason for temporarily halting its investigation.
“The Prosecution has temporarily suspended its investigative activities while it assesses the scope and effect of the deferral request,” ICC prosecutor Karim Khan said in a report.
Philippine Ambassador to the Netherlands Eduardo Malaya wrote to Khan to ask that the tribunal’s probe be deferred after the Department of Justice referred to the National Bureau of Investigation (NBI) 52 cases involving deaths in the police’s anti-drug operations.
Khan said the ICC prosecution would continue its analysis of the information it has on Duterte’s drug war and assess “the need for applications to the Pre-Trial Chamber for authority to conduct necessary investigative steps for the preservation of evidence under Article 18(6) of the Statute.”
“The Prosecution will, in the coming days, request additional information from the Philippines under rule 53 of the Rules of Procedure and Evidence,” he said.
