Justice Secretary Menardo Guevarra on Monday (Nov. 30) said he welcomes the decision of detained Sen. Leila De Lima to appeal before the Court of Appeals (CA) to decision of the Office of the Ombudsman (OMB) to dismiss her administrative complaint against him.
“Suffice it to say that Senator De Lima is free to take all available legal remedies, as she has freely done since the time that she was indicted for serious criminal offenses,” .
On the other hand, Guevarra declined to make further comments on the move made by the senator.
“If asked to comment, I will make the comment in court,” said Guevarra who explained that making public statements about the case would violate the sub judice rule.
“It is not my policy to discuss in public cases which are under litigation or review, because such act may constitute contempt of court which is punishable under existing rules,” he pointed out.
De Lima, who is detained of the Custodial Center of the Philippine National Police (PNP) in Camp Crame, is facing drug charges before the Muntinlupa City regional trial court (RTC) over her alleged involvement in the illegal drugs trade in the New Bilibid Prison (NBP).
The senator filed the administrative case before the OMB against Guevarra for using convicted drug lords as witnesses against her.
The OMB junked her complaint since the allegations against her were committed in prion and the only witnesses were prisoners.
