Malacañang on Monday denied that the agreement with China’s Sinovac Biotech Ltd. for 25 million doses of coronavirus vaccine is not yet a done deal.
In a televised briefing, Presidential Spokesperson Harry Roque clarified that the Sinovac procurement is already a binding obligation.
“Kapag meron na pong tinatawag na meeting of the mind pagdating doon sa consent, object and consideration, eh meron na po tayong obligasyon. Ang tawag dito ay isang obligasyon na subject to suspensive condition,” said Roque.
Quoting the New Civil Code, the Palace official said: “When the fulfilment of the condition results in the acquisition of rights arising out of the obligation, it is considered suspension. Ibig sabihin, kapag ang isang obligasyon ay nakadepende sa isang kondisyon na pupuwede o hindi pupuwede mangyari yan ay subject to suspensive condition.”
“Ito po ba ay hindi kontrata? Hindi po, kontrata na po yan. Kaya nga lang, yung pangalawang obligasyon, at ito ay ang pagbibili, ay naka-subject sa kondisyon na pinag-agree-han ng partido. Ano ang isa sa mga kondisyon na ito? Siyempre ang approval ng (Food and Drug Administration),” he added.
Roque was reacting to the statement of Finance Undersecretary Mark Joven that the government does not have an obligation to buy Covid-19 vaccine from China until they receive regulatory approval.
