Teacher Ronnel Mas has been cleared by the Zambales Provincial Prosecutor’s Office from sedition in connection with offering P50 million in Facebook for the killing of President Rodrigo Duterte.
In a resolution dated Feb. 16, Acting Provincial Prosecutor Leonard Santos dismissed the case that has been re-filed by the National Bureau of Investigation (NBI) after being dismissed in June 24, 2020 by the Olongapo City Regional Trial Court (RTC) Branch 72.
“In sum, nothing under this law (Cybercrime Prevention Act of 2012) has been complied with in the investigation and gathering of data to identify the perpetrator and effectively prosecute the same,” read the resolution.
The prosecutor pointed out “the complainant has already been appraised with the insufficiency of the NBI’s complaint by the court.”
“Knowing this flaw, the complainant in re-filing this complaint, has not adduced additional evidence to establish the identity of the perpetrator, I.e. the one who has actually posted the remarks inciting to sedition,” he pointed out.
The prosecutor reminded the extra-judicial confession of Mas before television reporters has already been ruled by the court as “not extant in the record of the case.”
Also, the prosecutor said Mas was arrested without a cyber-warrant, no digital digital forensic report on his mobile phone was attached to the complaint, and “as pronounced by the above-mentioned court, the warrantless arrest is not done under Rule 113, Sec. 5.”
