The House of Representatives has approved on second reading the measure regulating parking spaces and fees.
The proposed Parking and Operations and Fees Regulation Act (House Bill 7725) seeks to promote public safety and the general welfare of consumers who avail of parking facilities offered by business operators form unreasonable parking rates and fees while allowing reasonable return of investments.
Under the measure, health service establishments will be encouraged to offer their parking free of charge to confined patients and out-patients who avail of medical services. The maximum parking fee they can collect shall be P20 per hour.
Accommodation establishments will be encouraged to provide free two-hour parking to their customers. The maximum fee they can charge is P30 per hour.
Food service establishments will be encouraged to provide two-hour parking to their clients and can only charge a maximum of P20 per hour.
Educational institutions will be asked to provide free parking spaces for their officials, employees, facilities, students, and guests. For parking clients, they can charge a maximum of P20 per hour.
Retail establishments will be encouraged to offer free two-hour parking spaces for customers who shall provide proof of transaction amounting not less than P500. The succeeding hours will be charged P10 per hour but not to exceed P50 per day except for those who will be subjected to the overnight parking fees.
Corporate offices or facilities will also be asked to offer their parking spaces for free but will be allowed to charge a maximum of P40 for the first four hours and P20 every succeeding hour. But the parking fee shall not exceed P140 per day.
Open parking enterprises may impose P30 for the first three hours and P20 per succeeding hour.
Multilevel parking enterprises can charge P40 for the first three hours and an additional P20 per succeeding hour.
The maximum fee that can be charged to street parking shall be P50 per hour.
The maximum overnight parking and lost parking ticket fee shall be P150.
For exigent circumstances or in case of natural disasters such as floods, heavy typhoons, earthquakes, volcanic eruptions, landslides, and fires, covered establishments shall waive all parking fees.
Once the natural disaster ceases, the vehicles should be removed within 12 hours. Regular parking fees shall be imposed for vehicles that remain beyond the 12 hour period.
“Covered establishments shall maintain and provide security in their parking lots. They shall be responsible for the safety of their customers and parking clients and shall be liable for damages from invoking the waiver of liability in case of loss of property or damage to the customer’s or parking client’s vehicle,” the measure read.
All establishments covered by the measure charging parking fees shall issue parking receipt, install a sufficient number of CCTVs, and employ security guards.
Those who will charge beyond what was allowed in the measure will be fined P100,000 to P300,000 per customer and/or suspension or cancellation of business permits.
All covered establishments will be given six months from the effectivity of the implementing rules and regulation of the measure to make adjustments to comply.
