The 1987 Constitution does not prohibit President Rodrigo Duterte from joining the vice presidential race in 2022, according to Palace Spokesman Harry Roque.
Citing Section 4, Article VII of the Constitution, Roque said Duterte was only barred from a second term in office.
“There is no legal impediment for President Rodrigo Roa Duterte to seek the Vice-Presidency, contrary to the claims of certain quarters,” the official said in a recent statement.
“President Duterte is not running for the same office and same position,” he added.
Meanwhile, Roque said that it was “still premature” for some groups to challenge the legality of Duterte’s vice presidential bid as the chief executive has yet to make any final decision on the matter.
“The President has not made up his mind and filed his certificate of candidacy,” according to him.
