Marcos asks Comelec to dismiss disqualification petition

The lawyers of presidential candidate Ferdinand “Bongbong” Marcos Jr. reminded the Commission on Elections (COMELEC) that the former senator has already served in various elective posts.

His counsels, led by former solicitor general Estelito Mendoza pointed this out in his answer to the petition that sought to cancel his certificate of candidacy (COC)

“It is relevant and the Commission can take judicial notice that the respondent had previously been elected to several elective positions in government specifically governor of Ilocos Norte, member of the House of Representatives, and member of the Philippine Senate,” reads the answer that was filed last Nov. 19.

Because of this, his lawyers told the COMELEC that it should dismiss the petition which sought the cancelation of his COC.

The petitioners sought the cancelation of the COC since Marcos has already been convicted for tax offenses.

They cited that Tax Code imposes perpetual disqualification to public office to those who have been found guilty.

The presidential candidate is facing a number of petitions before the COMELEC including three seeking to cancel his COC, a petition to have him disqualified as candidate, and another that wanted him declared a nuisance candidate.
